       Terms & Conditions

The contract between the company and the customer and the acceptance of the company’s quotation will signify acceptance of these terms and conditions.

DK Carpentry & Building LTD will provide all customers with a written quotation, which will include sufficient detail for the completion of the works. If any clarification is required, please contact us so that we can provide it. Extra works can be provided subject to a written confirmation including cost.

A ‘contract’ with DK Carpentry & Building LTD is an agreement by the client to have work undertaken based on a written quotation headed ‘Quote/Estimate’ submitted directly to the client on an official DK Carpentry & Building LTD letterhead and is a clear and straightforward undertaking between the two parties to form a contract.

Once a quotation has been accepted (either verbally or in writing) and the customer has paid their deposit, then a contract has been entered into and these terms will come into effect. Quotes are valid for 60 days from the date on the quote.

Once the customer has entered into a contract with DK Carpentry & Building LTD by paying their initial holding fee deposit, they have a 14 day cooling off period should they wish to cancel the contract. The customer can cancel their contract within 14 days by either phone or email to DK Carpentry & Building LTD

The Company shall complete the works in accordance with this quotation with due diligence and in a good and workmanlike manner using materials and workmanship of the quality and therein specified.

The company shall use its best endeavours to complete the works within the period of time specified between the company and the customer, but this will not form the basis of the contract and he company shall not be liable for any delays caused by reasons beyond its

Reasonable control, including but not without prejudice to the generality of the forgoing,

Inclement Weather and delays in obtaining materials from suppliers.

Wherever possible a quotation will be given for any additional works or variations to the

Contract, but otherwise will be charged at a fair price based on the variation.

All materials and equipment on site which form part of the contract works shall remain the

Property and be exclusive possession of the company until such time as the contract sum has been paid in full.

All prices quoted are calculated on the basis of free access and unimpeded working during our normal working hours (8am – 4.30 Mon – Fri), unless otherwise agreed. Please note that we may be on site up until 6pm or on a Saturday which will be agreed with client if required

It is the customer’s responsibility to arrange any planning permission, building control, party wall surveyors and any utility changes (e.g. Severn Trent Water). If planning permission is required for the work, DK may request to see proof that this has been agreed prior to beginning work.

The Company will not be liable to the customer for any unforeseen site conditions not apparent at the time of survey and without opening up the existing structure or
Groundworks.

If on installation the building is found to have any structural defects, infestations or other

Serious defect the company shall inform the customer accordingly and agree to postpone

The works until the customer, at the customers expense, has rectified the problem.

In the event of any such postponement the company shall be entitled to be paid for all

Materials on site.

Commencement of work is under the assumption of uninterrupted work for the duration of the contract and in accordance with planning permission where applicable. DK will not be held liable for any costs incurred as a result of delays due to unforeseen circumstances. (e.g. planning permission delays resulting in work having to stop) or any extra work requested by building inspector

DK Carpentry & Building LTD will agree all practical arrangements with regards to working methods with the client in order to provide minimum disruption to the client and allow work to be carried out efficiently by the contractor.

Free access is required for delivery of building materials, plant, machinery, skips etc.

All new, fitted, used or removed materials on-site remain the property of DK Carpentry & Building LTD until full payment has been made, DKs rubbish or leftover material will be disposed of accordingly,

DK Carpentry & Building LTD may directly employ or sub contract labour to work on site. Each sub-contractor takes full responsibility for their own third party liability.

Gas Plumbing sub-contracts are Gas Safe registered. Electricians are Part P certified.

DK Carpentry & Building LTD will oversee all works to completion and takes full general and operational responsibility in the running of any contract agreed with the client.

DK Carpentry & Building LTD will provide a payment plan to the client prior to commencement of works. This will usually include a deposit, staged payments throughout job and an end payment, end payment is to be paid at end of main works, if a snag list is required to complete DK will work out a fair fee based on what’s to be done to hold back until the snagging is done. Deposits are non-refundable and allow DK to book work in and agree a formal start date for works and purchase materials. Please note: In the very unlikely event that DK have to cancel your work, your deposit will be fully refunded.

Invoices will be sent out prior to the relevant payment date and each invoice will serve as a receipt for payment. Payments must be made in a timely manner or work progress may be impeded or ceased (in the case of non-payment) The Company shall be entitled to charge interest on all outstanding monies at the  rate of 5% over Bank of England Base rate prevailing at the time the monies are due
Payments can be made by cheque, cash or bank transfer, All invoices include our bank details for bank transfers.

Insurance – Public Liability
DK Carpentry & Building LTD has Public Liability Insurance, All usual general building practices are covered within our insurance policy.

All client information is retained in accordance with the Data Protection Act 1988 and all personal and other customer details will remain confidential.

Guarantees: All customers will benefit from a full guarantee on our workmanship for a period of 12 months. Guarantees on materials run in accordance with manufacturer’s warranty periods where applicable. Our guarantee covers all new work and new materials used in construction or repairs, but do not guarantee the integrity of any existing structures, materials or decorations. In the event of a failure beyond the guarantee period we will be happy to investigate the cause and negotiate a solution to the problem without delay and carry out any agreed repairs as soon as possible. Charges may apply for remedial work carried out beyond guarantee dates or to items not covered by our guarantee.
Minor General building works i.e. plastering guarantee does not cover any negligence, physical damage caused by misuse, impact, abrasion, or cleaning with non-proprietary chemical. Please note we provide a 2 month guarantee for plastering work to allow for settling in time. Any claim under this guarantee must be made in writing to the company within fourteen days of the alleged defect becoming apparent.

No responsibility is taken by DK Carpentry & Building LTD for the presence of perished or rotten timber (or any other perished or rotten materials) in existing structures such as doors, windows and frames whether detected or undetected at the time of contract.

We will not be held responsible for the suitability of the existing boilers, electric board’s ability to provide for additional works. If the existing boiler or circuit board is found to be unsuitable, this shall be discussed with the customer and any work to required can be priced separately
If we have to remove existing radiators for any reason (e.g. plastering) we will not be held responsible for their effectiveness once they are replaced.

DK Carpentry & Building LTD will endeavour to protect existing surfaces with the use of dustsheets and loose plastic sheeting etc. along with care in our working practice. However, responsibility for protection from damage of any existing surface or fabrics etc. is the responsibility of the customer. Arrangement can be made to put in place protection of existing surfaces, over and above our basic cover, at a negotiated additional cost. We strongly recommend the customer moves any expensive or sentimental items before work commences. If we are required to move furniture to undertake our work we will not be held responsible for any breakages or stains that may occur.

We advise clients to keep all valuables and expensive items safe and secure for the duration of the works, as we cannot be held liable for any loss.

Discounts and retentions:

Prices are based on the understanding that no retentions are held unless previously arranged and authorised. No discounts are given unless agreed and confirmed in writing.

We will endeavour to employ a helpful attitude at all times and will always attempt to bring the building works to a satisfactory conclusion as soon as possible taking into account weather conditions, availability of specialist materials and unforeseen circumstances etc.

DK Carpentry & Building LTD takes pictures of the progress of our projects. We reserve the right to use these pictures in our portfolio of work, on our website and on various social media websites for marketing and information purposes. Please let us know via email at the start of your work if you are not happy with this.

DK Carpentry & Building LTD are not liable for any asbestos removal or costs incurred if found while working, the Customet must contact a suitable asbestos company to remove all
